Terms of service
Overview
Welcome to PharmaFoot UK. These Terms of Service explain the terms and conditions that apply when you visit our website, browse our products, create an account, or place an order through pharmafoot.co.uk.
These Terms should be read together with our Privacy Policy, Shipping Policy, and Return and Refund Policy.
By accessing our website, creating an account, adding products to your basket, or completing a purchase, you confirm that you have read and understood these Terms of Service and agree to be bound by them.
If you do not agree with these Terms, please do not use our website or place an order with us.
These Terms apply to all visitors, customers, and users of pharmafoot.co.uk.
Nothing in these Terms limits or affects any statutory rights you have as a consumer under applicable UK law.
1. Access and Your Account
To place an order through our website, you must be at least 18 years old or place the order with the permission and involvement of a parent or legal guardian.
When creating an account or placing an order as a guest, you agree to provide information that is accurate, complete, and up to date.
You must also be authorised to use any payment method submitted when placing an order.
You are responsible for keeping your account details and login credentials secure. You should not disclose your password or other account access information to another person.
If you believe that your account has been accessed without your permission, please contact us as soon as possible.
Accounts are personal to the account holder and should not be sold or transferred to another person.
2. Our Products
We make reasonable efforts to ensure that product descriptions, photographs, measurements, specifications, and other information displayed on our website are accurate.
However, product colours, textures, and appearance may vary slightly depending on screen settings, lighting conditions, manufacturing variations, photography, or other factors outside our reasonable control.
We cannot guarantee that a product will appear exactly the same on your device as it does in person.
Product information, availability, pricing, specifications, and designs may be updated from time to time. We may also discontinue products or limit their availability.
Nothing in this section affects your statutory rights where goods are faulty, not as described, or otherwise do not meet the standards required by applicable consumer law.
3. Orders
When you submit an order through our website, you are making an offer to purchase the products included in your order.
After placing an order, you may receive an order confirmation email confirming that we have received your order. This does not necessarily mean that your order has been accepted.
Unless we tell you otherwise, a contract between you and PharmaFoot UK is formed when we send you confirmation that your order has been dispatched.
We reserve the right to decline an order before it has been accepted where reasonably necessary, including where:
-
A product is unavailable.
-
Payment cannot be authorised.
-
We identify an incorrect price or material product information error.
-
We reasonably suspect fraudulent or unauthorised activity.
-
We are unable to deliver to the address provided.
-
An order breaches these Terms or any applicable law.
If payment has already been taken for an order that we are unable to accept, we will arrange a refund.
Once an order has entered processing, we cannot guarantee that changes or cancellations can be made. If you need to change or cancel an order, please contact us as soon as possible and we will do our best to assist.
This does not affect any statutory cancellation rights you may have.
Unless agreed with us in advance, products purchased through our website are intended for personal use and not for resale or commercial distribution.
4. Consumer Cancellation Rights
If you purchase from us as a consumer online, you may have a statutory right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
For most eligible goods, the statutory cancellation period ends 14 days after the day on which you, or a person nominated by you other than the delivery carrier, receives the goods.
Where a single order contains multiple goods that are delivered separately, the cancellation period will generally begin when the final item is received.
You do not need to provide a reason for exercising your statutory cancellation right.
To exercise your right to cancel, you must clearly inform us of your decision within the applicable cancellation period.
After notifying us that you wish to cancel, you will normally have a further 14 days to return the goods.
Certain products or circumstances may be excluded from the statutory cancellation right where permitted by law.
Our separate 30-day return policy may provide additional return rights beyond your statutory cancellation rights.
Full details regarding returns, return postage, exclusions, refunds, damaged goods, and how to initiate a return can be found in our Return and Refund Policy.
Nothing in our Return and Refund Policy or these Terms reduces your statutory consumer rights.
5. Prices and Payment
Prices displayed on our website may change from time to time.
The price applicable to your order will normally be the price shown during checkout when the order is submitted.
Changes to product prices after an order has been accepted will not affect that order.
Any delivery charges that apply to your order will be displayed during checkout before you complete your purchase.
Promotional offers, discount codes, or other promotions may be subject to additional conditions. Where specific promotional conditions apply, those conditions will apply alongside these Terms.
You agree to provide accurate and complete payment information when placing an order.
You confirm that you are authorised to use the payment method submitted.
Payments may be processed by Shopify Payments or other third-party payment providers. Payment information may therefore also be processed in accordance with the relevant payment provider's terms and privacy practices.
6. Pricing and Website Errors
We make reasonable efforts to ensure that prices, product details, promotions, and other information displayed on our website are accurate.
Occasionally, errors or omissions may occur.
If we identify a material pricing, product information, or availability error before your order has been accepted, we may contact you and give you the opportunity to proceed based on the corrected information or cancel the affected order.
If we are unable to contact you, we may cancel the affected order and refund any payment already received.
Where a contract has already been formed, we will deal with any error in accordance with applicable law and your statutory consumer rights.
Nothing in this section gives us an unrestricted right to cancel an accepted order or remove rights that you have under consumer law.
7. Shipping and Delivery
Information about our delivery locations, estimated delivery times, processing times, and shipping charges is available in our Shipping Policy.
Delivery dates and timeframes are estimates unless we expressly agree otherwise.
Delays may occasionally occur because of matters outside our reasonable control, including carrier disruptions, adverse weather, unusually high order volumes, transport disruptions, or other circumstances.
If there is a significant delivery problem, please contact us and we will assist you.
For consumer orders, the goods remain at our risk until they come into the physical possession of you, or another person identified by you to receive them, except where you independently arrange your own carrier in circumstances where the law provides otherwise.
If your parcel is lost or damaged before delivery to you, please contact us so that we can investigate the matter and provide any remedy required under applicable law.
8. Returns, Refunds and Faulty Goods
Our return process is explained in our Return and Refund Policy.
Our voluntary return policy operates in addition to your statutory rights and does not replace them.
Under the Consumer Rights Act 2015, goods supplied to consumers must meet applicable legal requirements, including requirements relating to satisfactory quality, fitness for purpose, and correspondence with their description.
If you believe an item is faulty, damaged, incorrect, or not as described, please contact us so that we can review the issue and provide an appropriate remedy where required.
Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or restricted.
9. Intellectual Property
Unless otherwise stated, content available on pharmafoot.co.uk, including product descriptions, photographs, graphics, logos, branding, written content, website design, and other materials, is owned by or licensed to PharmaFoot UK.
This content may be protected by copyright, trademark, and other intellectual property laws.
You may access and use our website content for your own personal and non-commercial purposes.
You must not reproduce, republish, modify, distribute, sell, commercially exploit, or otherwise use our content without our prior permission except where permitted by law.
Our name, branding, logos, and other intellectual property must not be used without our permission.
Third-party trademarks and intellectual property displayed on our website remain the property of their respective owners.
10. Optional Tools and Services
From time to time, our website may provide access to tools, applications, or features operated by third parties, including review services, payment providers, sizing tools, analytics services, or customer support features.
These services may be operated independently from PharmaFoot UK.
We do not control every aspect of third-party services and cannot guarantee their continued availability or performance.
Your use of a third-party service may also be governed by that provider's own terms and privacy policy.
We may introduce additional website features, services, integrations, or tools in the future. Where appropriate, these will also be subject to these Terms.
11. Third-Party Links
Our website may contain links to websites, services, or resources operated by third parties.
A link to a third-party website does not necessarily mean that we endorse or control that website.
We are not responsible for third-party websites or their content, availability, security, terms, or privacy practices.
You should review the terms and privacy policies of any third-party website before providing personal information or completing a transaction with that third party.
12. Our Relationship With Shopify
Our online store is hosted and supported by Shopify, which provides the ecommerce technology that enables us to display products, process orders, manage customer accounts, and provide other store functionality.
When you purchase products through pharmafoot.co.uk, your purchase is from PharmaFoot UK rather than Shopify.
Shopify is not the seller of the products offered by PharmaFoot UK and is not responsible for fulfilling your order or providing remedies relating to the products we sell.
Certain information may be processed by Shopify as part of providing its ecommerce services.
Further information about how personal information is handled is available in our Privacy Policy.
13. Privacy and Personal Information
We collect, use, and process personal information in accordance with our Privacy Policy.
When you browse our website, create an account, contact us, or place an order, information may also be processed by Shopify and other service providers that assist us with functions such as payment processing, fulfilment, analytics, website operation, marketing, and customer support.
Please review our Privacy Policy for further details regarding the personal information we collect, how it is used, your rights, and how to contact us about privacy matters.
14. Feedback, Reviews and User Content
If you provide reviews, comments, photographs, feedback, suggestions, ideas, or other content relating to our products or services, you confirm that you have the right to provide that content.
You must not submit content that:
-
Infringes another person's intellectual property or other legal rights.
-
Contains knowingly false or misleading information.
-
Contains unlawful, threatening, abusive, defamatory, obscene, or harmful material.
-
Contains malicious software or other harmful code.
-
Violates applicable law.
Where you voluntarily submit content for publication, you grant us permission to use, reproduce, display, and publish that content for reasonable business purposes, including operating our website, promoting our products, and improving our services.
This permission does not transfer ownership of your original content to us.
We may remove or decline to publish content where we reasonably believe it breaches these Terms or applicable law.
You remain responsible for content you submit.
15. Prohibited Uses
You must not use our website:
-
For an unlawful or fraudulent purpose.
-
In violation of any applicable law or regulation.
-
To infringe our intellectual property rights or the rights of another person.
-
To submit false, fraudulent, or misleading information.
-
To distribute viruses, malware, malicious code, or other harmful material.
-
To attempt to gain unauthorised access to our website, systems, accounts, or data.
-
To improperly collect or misuse personal information belonging to another person.
-
To interfere with the operation, availability, integrity, or security of our website.
-
To conduct unauthorised automated scraping, crawling, or data extraction that interferes with our website or systems.
-
To impersonate another individual or organisation.
We may restrict or suspend access to our website where reasonably necessary to protect our business, customers, website, or legal rights.
16. Suspension and Termination
We may suspend or terminate your access to an account or certain website services where we reasonably believe that you have materially breached these Terms, engaged in unlawful activity, attempted fraud, compromised website security, or used our services in a way that could cause harm.
Where appropriate and reasonably possible, we may provide notice before taking such action.
Suspension or termination does not affect rights or obligations that arose before termination.
Sections of these Terms that are intended by their nature to continue after termination will remain effective.
17. Website Availability
We take reasonable steps to maintain the availability and accuracy of our website.
However, we cannot guarantee that the website will operate without interruption or that it will always be free from technical errors.
We may temporarily suspend or restrict access for maintenance, security, technical improvements, or circumstances outside our reasonable control.
Nothing in this section excludes responsibilities that we cannot lawfully exclude.
18. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or limits liability for:
-
Death or personal injury caused by negligence.
-
Fraud or fraudulent misrepresentation.
-
Breach of statutory consumer rights that cannot legally be excluded or restricted.
-
Faulty goods where liability cannot lawfully be excluded.
-
Any other liability that cannot legally be excluded or limited.
If you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Unless we have expressly agreed otherwise, our products and website are supplied for personal and domestic use. We are not responsible for business losses, including loss of profits, revenue, business opportunity, or commercial interruption, arising from a consumer purchase.
Nothing in this section affects your statutory rights.
19. Misuse of Our Website
You are responsible for losses or liabilities that result directly from your own unlawful or fraudulent misuse of our website where applicable law permits us to recover those losses.
We will not seek to make a consumer responsible for losses that were caused by us, that were outside the consumer's reasonable control, or where doing so would be contrary to applicable consumer law.
This section does not restrict any rights or remedies available to either party under applicable law.
20. Severability
If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid, or unenforceable, that provision will be treated as removed or modified only to the extent necessary.
The remaining provisions will continue in effect.
21. Waiver and Entire Agreement
If we do not immediately enforce a right or provision under these Terms, this does not mean that we have waived that right.
These Terms, together with the policies and other terms expressly incorporated into them, form the agreement between you and PharmaFoot UK relating to your use of our website and purchases made through it.
Nothing in this section excludes any information or representation that cannot legally be excluded.
22. Assignment
You may not transfer your rights or obligations under these Terms to another person without our agreement, except where the law permits you to do so.
We may transfer our rights or obligations under these Terms to another organisation, for example as part of a sale, restructuring, merger, acquisition, or transfer of our business.
If such a transfer materially affects your rights, we will take reasonable steps to ensure that your rights continue to be protected.
23. Governing Law and Disputes
These Terms are governed by the laws of England and Wales.
If you are a consumer, you will continue to benefit from any mandatory legal protections that apply to you and cannot lawfully be excluded by these Terms.
Where permitted by applicable law, disputes may be brought before the courts of England and Wales.
If you live elsewhere in the United Kingdom or another jurisdiction that gives you mandatory rights to bring proceedings in your local courts, nothing in these Terms removes those rights.
We encourage you to contact us first if you have a concern so that we can try to resolve the matter directly.
24. Changes to These Terms
We may update these Terms from time to time to reflect changes to our services, business practices, website functionality, or legal and regulatory requirements.
The latest version will be published on this page together with the date it was last updated.
Changes to these Terms will apply from the date the updated Terms are published unless otherwise stated.
Changes will not retrospectively alter the terms that applied to an order that was already accepted before the updated Terms came into effect, unless required by law or agreed with you.
We recommend reviewing these Terms periodically.
25. Other Policies
The following policies form part of the information governing your use of our website and purchases from PharmaFoot UK:
Where there is a conflict between these Terms and a specific policy relating to a particular matter, the more specific policy will apply to that matter, except where doing so would reduce or remove rights that you have under applicable law.
